Terms of Use and Disclaimer

Copyright / Contents Rights
All text, images, graphics, video sequences, audio files and other material published on the website of the MuseumsQuartier Errichtungs- und BetriebsgesmbH (hereinafter referred to as 'the Media Owner' or 'MQ E+B GesmbH') are protected by copyright and remain the property of the Media Owner or its partners.  The user is granted no copyright, exploitation, licencing or editing rights whatsoever to the content irrespective of the ready availability of its retrieval. The information on the website is intended only for personal use.  Any use beyond personal use, in particular the saving or downloading of data or content to databases, duplication and any form of commercial use as well as distribution to third parties whether in part or in edited form is prohibited without the consent of MQ E+B GesmbH.

Content of Online Resources
The Media Owner provides the user with access to content (texts, photographs, videos, graphics, audio files etc., hereinafter referred to as 'content') through its online and mobile website 'www.mqw.at'.  The essential resources provided by the Media Owner are on the one hand the operation of the website and on the other hand the provision of information.
The Media Owner advises users that they use these resources at their own risk.

Free Use
Use comes into effect by connecting to the website mqw.at. The use of mqw.at and its resources is free of charge. No future legal claims can be inferred from the cost-free use of these resources. 

Rights and Obligations of the Media Owner
The user acknowledges that the content and services are created for the needs and requirements of the community.  The Media Owner ensures to the best of its knowledge and belief that the content that appears on the website is correct. MQ E+B GesmbH however gives no guarantee and assumes no liability whatsoever for the accuracy, currency, correctness or completeness of the available content and services or for a specific use.  The Media Owner shall not be liable to the user for any disruption, interruption, delay, deletion, defective transmission, storage failure in connection with the use of the services or for other damages arising from the use or inaccessibility of the data and information on this website.
The Media Owner expressly reserves the right to change, supplement, delete the website in part or its entirety or to suspend or discontinue its publication, for example for maintenance purposes, without giving prior notice.  The user can derive no claims in such cases. In return the Media Owner will work to resolve any disruptions as quickly as possible.
The user acknowledges that the services offered by the Media Owner are also offered with the involvement of third-party network operators.  The availability of the services is therefore dependent upon the technical provision of third-party services, over which the Media Owner has no influence.

Obligations of the User
The user undertakes to use the services only in compliance with statutory provisions, in particular the copyright and data protection laws, and to refrain from any improper use. The user guarantees not to infringe on any rights when using the services.

References and Links
The Media Owner assumes no liability for third-party content to which reference is made via direct or indirect links.  MQ E + B GesmbH has no influence whatsoever on the present and future design, content or authorship of the linked and/or associated websites, the responsibility for which lies solely with the provider of this content. The same applies to all links and references that are included within that provider's own content. For illegal, incorrect or incomplete content and especially for damages resulting from the use or non-use of such information, the provider of the page to which reference was made is liable. MQ E + B GesmbH endeavours to observe the copyrights of the texts, images, graphics, video sequences and sound documents used in its publications, or to use texts, illustrations, graphics, video sequences and audio files produced by MQ E + B GesmbH itself or its contractual partners, or to use license-free texts, images, graphics, video sequences and sound files. The copyright for items produced by MQ E + B GesmbH itself or its contractual partners remains solely with MQ E + B GesmbH. Use by Companies of Offered Services
Should one of the offered services be used on behalf of a company, this company accepts these Terms of Use. The Company indemnifies and exempts MQ E + B GesmbH and its employees, representatives and staff from any legal proceedings or claims arising out of or in connection with the use of the services or any breach of these Terms of Use, including all claims and costs arising from lawsuits, losses, damages or legal proceedings as well as court and attorney fees.

Cookie Policy

Remarketing or 'Similar Audience' Feature of Google Inc. 
The Media Owner uses the remarketing or 'Similar Audience' feature of Google Inc. ('Google') on this website.  Using this feature, personalised, interest-based advertising will appear to visitors of the website of the provider when they visit other websites in the Google display network. Google uses cookies to analyse website usage, forming the basis for generating interest-based advertising. To do this, Google stores a small file containing a numerical sequence in the browsers of visitors to the web site. Visits to the website as well as anonymous data about the use of the website are collected through this number. The personal data of visitors to the website is not stored. Social Media Cookies
Social media plug-ins are integrated into the website to promote and share articles on social networks such as Facebook and Twitter. A two-staged process is used for this. Data to third parties will not be transferred until users click on one of the icons displayed in the social media bar. The Media Owner has no influence over or access to the cookies set by Facebook, Twitter etc.

Privacy Policy

Ongoing use: the Media Owner processes the following data while the services are used: web log information (including IP address and time of use), device data and browser data.


Newsletter Registration
By registering to receive any of the newsletters offered (MQ, MQ Point, Premium Event Locations, Q21 und frei_raum Q21 exhibition space), you, as the user, agree that your first and last names and email address will be processed by MuseumsQuartier E+B GesmbH (Museumsplatz 1, A-1070 Wien) in order to send the respective newsletter(s) to you.

The personal data provided to us is used exclusively for this purpose and with your consent.

You have the right to withdraw your consent to the use of your personal data by sending an e-mail to newsletter@mqw.at at any time. Alternatively, you can click on the 'unsubscribe' link included in each newsletter. The withdrawal of consent does not affect the legality of the personal data processed up until the point of revocation.

We ask that you notify us of any changes to your contact details.

Use of Facebook Social Plugins
This website uses social plugins ('plugins') from the social network facebook.com which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ('Facebook'). The plugins are identified by a Facebook logo or the 'Share' button. Should the user make use of these services, the platform will establish a direct connection to Facebook's server. The content of the plugin will be relayed by Facebook directly to the platform and integrated into the website. Through the integration of the plugin, Facebook is informed that the user has accessed the platform. If the user is logged on to Facebook, Facebook can allocate the visit to the user's Facebook account. If the user interacts with the plugin, e.g. by clicking the 'Like' button or by posting a comment, the corresponding information will be relayed directly to Facebook and stored. For information regarding the purpose and extent of data capture and the further processing and use of data by Facebook, as well as rights in this respect and settings options for the protection of personal privacy, the user can refer to Facebook's privacy policy: Facebook data protection information. Use of Twitter Social Plugins
This website uses social plugins ('plugins') from the social network twitter.com, provided by Twitter Inc., 795 Folsom Street, Suite 600, San Francisco, CA 94107, USA. The plugins are marked with a Twitter logo or the 'Share' button.
Should the user be logged-in to a Twitter account, the use of the 'Retweet' function will link the websites visited by the user to the user's Twitter account, thereby making them known to third parties. By using this website, the user consents to the processing of data collected about him or her by Twitter in the manner described above and for the previously stated purposes.

Use of Google Maps
The Media Owner's services make use of Google Maps to create maps and generate directions. Google Maps is operated by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. If the user should make use of this platform, a direct connection with Google's servers will be established, thereby providing Google with device-specific data, location data, IP address (log files) and cookie information.  By using the platform, the user consents to the transmission, collection, processing and use of the automatically collected data by Google.

Storage
If an existing internet connection is in use, the data listed above is transmitted to the Media Owner and processed by the Media Owner for the purpose of providing the services and for security and storage purposes (see also Cookie Policy, above).

Approval
As a user of the website, you expressly agree that MuseumsQuartier E + B GesmbH may process and use your personal data for the purposes of providing access to the services, for the analysis of user behaviour, for the sending of advertising content and for other marketing measures employed for its own purposes.

Rights of the User
You have a right to information regarding your personal data that we have stored, its origin and recipients and the purpose for which it is processed, as well as a right to the correction, transmission, opposition, restriction of processing as well as the right to the blocking or deletion of incorrect or unlawfully processed data.

If you believe that the processing of your personal data by us breaches the applicable data protection law or that your rights to data protection have been infringed upon in another way, you have the opportunity to complain to the regulatory authority. In Austria, the Data Protection Authority is responsible for such complaints (for more information on the General Data Protection Regulation, see: EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ).

Cancellation
We point out that you may withdraw the respective declarations of consent regarding the use of your data at any time or change your browser's privacy settings accordingly. Consequences of Cancellation
The revocation of consent makes any further use of such data inadmissible.  For the avoidance of doubt, however, the Media Owner points out to the user that in this case the Media Owner remains entitled to have the data at its disposal, insofar as the data is still required for the fulfilment of contractual obligations.
